Spite License Agreement

This is an agreement between you and the maker of Spite ("we", "us"). By clicking "Agree and activate" or by installing or using Spite, you accept it. If you do not accept it, do not use Spite and ask for a refund under the refund terms that applied when you bought it.

1. What you may do

When you buy Spite, we give you a personal, non-exclusive, non-transferable license to install and use Spite on up to two computers that you own or control, for personal or business work. Each license is for one person. You may move your license to a different computer by deactivating it on one of yours first.

2. What you may not do

• Copy, share, sell, rent, lend, sublicense or give away Spite or your license key, or let other people use your key.
• Reverse engineer, decompile, disassemble or try to recover Spite's source code, except to the extent the law where you live allows it despite this agreement.
• Remove, disable or get around Spite's license check or any other protection in it.
• Change Spite, make products based on its code, or use its code to build something that competes with it.
• Use Spite to record people without the notice or permission the law requires.

3. Who owns Spite

Spite is licensed, not sold. We keep all rights in Spite, its code, its design and the Spite name and logo, except the rights this agreement gives you.

4. Your recordings and your data

• Your recordings are saved on your computer. We do not receive them.
• If you turn on transcription, Spite sends your narration to OpenAI with your own OpenAI API key, and OpenAI's terms apply to that.
• AI apps you connect to Spite (such as Claude, Cursor, Codex or ChatGPT) can read your recordings through Spite. Their own terms apply to what they do with them.
• To check your license, Spite sends your license key and this computer's name to Lemon Squeezy, which sells Spite for us.
• Spite keeps logs on your computer. They are only sent to us if you choose to send a report.

5. Updates

We may release updates. Updates are covered by this agreement unless they come with a new one, which Spite will ask you to accept.

6. Ending this agreement

This agreement lasts until it ends. It ends automatically if you break it, or if your purchase is refunded or reversed. When it ends you must stop using Spite and remove it.

7. No warranty

Spite is provided "as is", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We do not promise that Spite will be error-free or work without interruption, or that an AI app will understand or act correctly on what Spite gives it.

8. Limit on liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for lost data, profits or work, and our total liability for anything to do with Spite is limited to the amount you paid for it. Some places do not allow these limits, so they may not apply to you.

9. Law

This agreement is governed by the laws of the State of Ohio, USA, without regard to its conflict-of-law rules. If any part of it cannot be enforced, the rest still applies.

10. The whole agreement

This is the whole agreement between you and us about Spite, and replaces anything said before about it.
